Business-Purpose Lending

1st Private Capital, Inc. originates business-purpose loans secured by real estate. Eligibility is determined by the use of loan proceeds, underwriting, documentation, and applicable law. Owner-occupied properties may qualify in states where such lending is permitted, when proceeds are used for an eligible business purpose.

Business-purpose loans are not consumer loans. They are made for commercial or investment purposes and are not intended for personal, family, or household use. Because of that, they are not subject to the same body of consumer mortgage regulation, and the disclosures that accompany a consumer mortgage do not apply in the same way. Borrowers should understand this distinction before proceeding, and should consult their own legal and tax advisors.

No rate, structure, timeline, term sheet, quote, or indication described on this site or generated by any tool on it is binding. Terms become binding only when set out in a written agreement signed by an authorized officer of 1st Private Capital, Inc. Program parameters are subject to change without notice, and any transaction remains subject to satisfactory title, insurance, valuation, documentation, and closing conditions.

Licensing

Licensing requirements for business-purpose real estate lending vary by state. Some jurisdictions require a license or registration to originate these loans, some provide exemptions for business-purpose or commercial transactions, and some do not regulate them in the same manner. We originate only where we are permitted to do so.

Other Jurisdictions

Licensing obligations are determined by the state in which the property securing the loan is located, not by where we are based. We originate outside California only where we are permitted to do so.

Where a transaction is introduced by a mortgage broker, real estate professional, or other third party, that party is not an agent of 1st Private Capital, Inc. unless we have said so in writing, and is not authorized to make representations, commitments, or quotes on our behalf. Compensation arrangements with introducing parties, where they exist, are governed by separate written agreement and applicable law.
